VALUE NET (PTY) LTD TERMS & CONDITIONS OF SERVICE

1. Detailed Description of Goods and Services
1.1. Value Net (Pty) Ltd is a private business in the trade and logistics industry that procures, packages, transports and delivers orders.

1.2. All processed orders are charged a service fee by Value Net (Pty) Ltd which includes all the applicable procedures followed to fulfil the order: procurement, collection, packaging & handling, storage, transport, border processing and direct delivery whereby Value Net (Pty) Ltd reserves the right to charge accordingly at our discretion.

1.3. The service fee charged varies with every order and is dependent on the value, quantity, weight, volume of the goods & applicable processes required.

1.4. When using Value Net (Pty) Ltd Freight Forward services, it is the client’s responsibility to settle payment to the applicable supplier/s as well as any fee’s including delivery to the Value Net (Pty) Ltd address. In the event that Value Net (Pty) Ltd agrees to handle payment on the clients’ behalf/collection of goods – this charge will be included in the Service Fee.

1.5. Goods will only be purchased after the client is satisfied with the overall product/s requested, accepts the given quotation and pays the amount due. Orders will not be dispatched until full payment – including the Service Fee is paid to Value Net (Pty) Ltd.

1.6. The VIN/Chassis number/year model/pictures where applicable of the vehicle/auto parts needs to be provided to ensure correct pricing is quoted/invoiced.

1.7. Quotations are valid for 7 days and are subject to price changes without prior notice.

1.8. Prices on second hand goods [i.e. auto spares]  are subject to availability [24-48hrs].

1.9. VAT applies to all sales within South Africa, all prices of items quoted by Value Net (Pty) Ltd are VAT inclusive. No VAT is claimed back on all orders fulfilled by Value Net (Pty) Ltd as we work with 3rd party transporters.

1.10. Any incurred charges; i.e. bank charges and tax deductions – should be taken into consideration by the client before acceptance of the quotation and/or brought to the attention of Value Net (Pty) Ltd. The client is liable for such fee’s which are not to affect or be deducted from the total cost of items and services charged by Value Net (Pty) Ltd.

2. Delivery Policy

2.1. Subject to availability and receipt of payment for purchases and freight forwarding services, requests will be processed and delivery confirmed through customers preferred method of communication (Email/WhatsApp) through receipt of order confirmation with order/invoice number in which all costs for the applicable processes – including transportation, duty and delivery will be included.

2.2. The transit time is 4-8days from dispatch before delivery. The expected delivery date is approximate and Value Net (Pty) Ltd does not warrant that delivery will be within the estimated time, but will always use its best efforts to do so. Any delay after dispatch [beyond the transit time] will be communicated with the client.

2.3. Where stock is not readily available from the supplier/s, Value Net (Pty) Ltd is not held liable for any delays with the processing and delivery of the order. Such delays are not accounted for in the order transit time and may extend this period.

3. Export

3.1. The offering on this website is currently available to Malawi & Mozambique, Zambia & Namibia whereby the service fee charged includes all the applicable processes until delivery/collection point.

4. Return, Damages and Refunds Policy
4.1. The provision of goods and services by Value Net (Pty) Ltd is subject to availability. In cases of unavailability where payment has been settled, Value Net (Pty) Ltd will refund the client in full within 30days or hold the amount paid as credit.

4.2. Any shortage or damage must be notified within 24hrs of receipt of goods. Complaints will only be accepted if made in writing within 48hrs from receipt of delivery. This does not guarantee further action from Value Net (Pty) Ltd and no goods will be returned without prior authorisation.

4.3. With authorisation certain goods qualify for return to Value Net (Pty) Ltd within a 5-day period. Goods eligible for return must remain unused and in the original packaging, a handling fee will be calculated and levied on all the correctly returned goods payable by the client. Credit will not be passed on electrical items, glass items/breakables and special order items.

4.4. Value Net (Pty) Ltd is not liable for any damages caused during installation, work or use of the goods, in the case of vehicle parts; goods fitted may not be returned. Electronic goods and components supplied by Value Net (Pty) Ltd will not be accepted for refund as well parts that have been tampered with and fitted into a vehicle.

4.5. The standard manufacturer’s warranty applies to the goods, and it is the clients’ responsibility to familiarize themselves therewith.

4.6. All goods are packaged accordingly ensuring that they are secure and weatherproofed before dispatch. However, in the unfortunate case of damages during transit, as a 3PL provider Value Net (Pty) Ltd is not liable for any damages [See 4.2 and 4.3] but will consult with the client on the matter until a fair compromise is agreed by and satisfies both parties.

5. Customer Privacy Policy
5.1. Value Net (Pty) Ltd shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act of 2000 (PAIA). 5.2. Value Net (Pty) Ltd operates in the Republic of South Africa. The company is fully compliant with the Protection of Personal Information Act No. 4 of 2013 (“POPIA”) and acts as both a responsible party and an operator on behalf of data subjects that Value Net (Pty) Ltd performs processing for. Value Net (Pty) Ltd is committed to compliance with all relevant South African laws in respect of personal data, and the protection of the “rights and freedoms” of individuals whose information Value Net (Pty) Ltd collects and processes in accordance with POPIA.
5.3. This Data Privacy Policy Notice is intended to provide transparency to data subjects about what happens with their personal data.
5.4. POPIA applies to the processing of personal data wholly or partly by automated means (i.e. by computer) and to the processing other than by automated means of personal data (i.e. paper records) that form part of a filing system or are intended to form part of a filing system.
5.5. POPIA will apply to the processing of all personal information for a responsible party where the responsible party is domiciled in the Republic of South Africa or not domiciled in the Republic, but makes use of automated or non-automated means in the Republic, unless those means are used only to forward personal information through the Republic.

6. Payment Options Accepted
6.1. Payment may be made via local deposit, direct transfer/EFT, Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Value Net (Pty) Ltd bank account (details of which will be provided on request). Please contact us for more information or assistance.

7. Card Acquiring and Security
7.1. Card transactions will be acquired for Value Net (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

8. Customer Details Separate from Card Details
8.1. Customer details will be stored by Value Net (Pty) Ltd separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za

9. Merchant Outlet County and Transaction Currency
9.1. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

10. Responsibility
10.1. Value Net (Pty) Ltd takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

11. Prohibited Use & Disclaimer of Liability
11.1 Any commercial or promotional distribution, publishing or exploitation of the Value Net (Pty) Ltd website, or any content, code, data or materials on the Website, is strictly prohibited unless you have received the express prior written permission from authorized personnel of Value Net (Pty) Ltd or the otherwise applicable rights holder. Other than as expressly allowed herein, you may not download, post, display, publish, copy, reproduce, distribute, transmit, modify, perform, broadcast, transfer, create derivative works from, sell or otherwise exploit any content, code, data or materials on or available through the Website. You further agree that you may not alter, edit, delete, remove, otherwise change the meaning or appearance of, or repurpose, any of the content, code, data, or other materials on or available through the Website, including, without limitation, the alteration or removal of any trademarks, trade names, logos, service marks, or any other proprietary content or proprietary rights notices.
11.2 The website owner shall not be responsible for and disclaims all liability for any loss, liability, damage personal injury or expense of any nature whatsoever which may be suffered by you or any third party, as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, to your or your company’s personal information or material and information transmitted over our system.

12. Country of Domicile
12.1. This website is governed by the laws of South Africa and Value Net (Pty) Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

13. Variation
13.1. Value Net (Pty) Ltd may, in its sole discretion, change this agreement or any part thereof at any time without notice.
